Terms of Service

These terms govern your use of the (IM)PERMANENT website at im-permanent.com and of the (IM)PERMANENT platform, operated by Two Black Dogs B.V., Sleutelstraat 15, 2000 Antwerp, Belgium. By using either, you agree to them. If you do not agree, do not use them.

1. What the Service Is

(IM)PERMANENT is a fashion design reference and archive platform. It gives approved users access to high-fidelity 3D scans and records of fashion pieces for research and design reference.

It is not a shop. Nothing is offered for sale through it, no goods are dispatched and no payment is taken on it. Access is arranged separately.

2. Accounts and Eligibility

  • Accounts are for organisations and professionals, and you must be at least 18 years old to hold one. The service is not directed at children.
  • Registration does not by itself grant access. Every new account is reviewed and approved by us before it becomes usable, and we may decline without giving reasons.
  • You are responsible for keeping your credentials confidential and for everything done under your account. Tell us immediately if you believe it has been compromised.
  • Accounts are personal. Do not share a login, and do not let anyone use the service through your account who is not entitled to use it themselves.

3. Acceptable Use

You agree not to:

  • Scrape, bulk-download, republish or redistribute the archive, its imagery or its 3D assets, whether by hand or by automated means.
  • Use the service, its imagery or its assets to train a machine learning model without our written permission.
  • Attempt to access data, accounts or systems you have not been granted access to, or to probe, scan or test the security of the service.
  • Interfere with the service or place a disproportionate load on it, including by circumventing rate limits.
  • Upload content you have no right to upload, content that infringes anyone's rights, or malicious code.
  • Use the service for anything unlawful, or to harass or defame anyone.

Use of the contact form on this website is subject to the same acceptable-use expectations, and we rate-limit and filter it against abuse.

4. Content You Upload

  • You keep ownership of everything you upload. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, reproduce and display it for the sole purpose of operating the service for you and your organisation.
  • You confirm you hold the rights necessary to upload it, and that doing so does not infringe anyone else's copyright, trade marks, image rights or privacy.
  • Where you sign a copyright or IP attestation in the platform, that attestation is a record of an assessment you made. We retain it, and it is not removed by deleting your account.
  • We may remove content we reasonably believe to be unlawful or in breach of these terms.

5. Our Intellectual Property

The service itself – the software, the interfaces, the (IM)PERMANENT name and brand, the archive as a compiled work, and the 3D reconstructions we produce – belongs to us or to our licensors. Your access grants you a limited, revocable, non-transferable right to use it for internal design reference and research, and nothing more. All rights not expressly granted are reserved.

6. Availability

We do not promise that the service will be uninterrupted or error-free. We may change, suspend or withdraw features, and we perform maintenance that can make the service unavailable. We will give notice of planned interruptions where we reasonably can.

7. Disclaimer and Liability

The service is provided "as is". To the fullest extent permitted by law we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. Archive records are a reference resource; we do not warrant that every attribute, measurement or attribution in them is accurate.

We are not liable for indirect or consequential loss, loss of profits, loss of business or loss of data. Our total liability arising out of or in connection with these terms is limited to the amounts paid for access to the service in the twelve months before the event giving rise to the claim, or €1,000 where no amount was paid.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or under mandatory Belgian consumer law where it applies to you.

8. Suspension and Termination

You may stop using the service at any time and may delete your account from your profile page. We may suspend or terminate access if you breach these terms, if your account presents a security risk, or if we stop offering the service.

Sections 4 (as to content already uploaded), 5, 7 and 10 survive termination.

9. Privacy

How we handle personal data is set out in our Privacy Policy, which forms part of your agreement with us. It is not summarised here, so that there is only ever one version of it to keep accurate.

10. Governing Law and Jurisdiction

These terms are governed by Belgian law. The courts of Antwerp, Belgium have exclusive jurisdiction over any dispute arising out of them, without prejudice to any mandatory right you may have to bring proceedings in the courts of your own place of residence.

11. Changes to These Terms

We may update these terms. The version number and effective date at the top of this page always identify the current version, and we will give notice of material changes to account holders. Continuing to use the service after a change takes effect means you accept it.
